Federal Way Municipal Court and DUI Cases

The Federal Way Municipal Court is the first stop for most DUI cases that happen inside city limits. It handles misdemeanor and gross misdemeanor charges. The court is located at 33325 8th Ave S, Federal Way, WA 98003, and can be reached at (253) 835-3000.

In Washington, most DUI charges are gross misdemeanors. This covers first, second, and third offenses within a ten-year period. Gross misdemeanor DUI carries up to 364 days in jail and up to a $5,000 fine. But the law also sets mandatory minimums that judges must impose. Actual sentences depend on offense history and BAC level.

For a first offense with BAC under 0.15, the minimum is 24 hours in jail and a $350 fine. If the BAC was 0.15 or higher, or if the driver refused a breath test, the minimum goes up to 48 hours in jail and a $500 fine. Felony DUI Cases: King County Superior Court

When a DUI charge meets the felony threshold, it leaves municipal court and goes to King County Superior Court. Under RCW 46.61.502, a fourth or subsequent DUI within ten years is a Class B felony. Other factors can also elevate a charge, including DUI with a minor in the vehicle.

King County Superior Court is based in Seattle at 516 Third Ave, Seattle, WA 98104. A Class B felony DUI carries up to 10 years in state prison and up to a $20,000 fine. Washington uses sentencing guidelines for felonies. Certified copies of court records are $5 for the first page and $1 for each additional page. Plain copies are $0.50 per page. To request copies, write to the court clerk with the case number, the subject's full name and date of birth, the documents you need, and your payment. Some courts accept payment by mail; others require you to appear in person.

Washington DUI Penalty Structure

Penalties are spelled out in RCW 46.61.5055. Court records for any DUI conviction will reflect which penalties were imposed. Those records are public and can be searched by anyone.

Third offense minimums: 90 days in jail plus 120 days of electronic home monitoring, a $1,000 fine, a three-year license suspension, and mandatory alcohol or drug assessment and treatment. Courts can also impose longer sentences if the facts warrant it.

After arrest, the officer sends a sworn report to the DOL. The DOL then notifies the driver of an impending suspension. The driver has 20 days from the arrest date to request a hearing to fight the suspension. This is a hard deadline. If you miss it, the suspension goes into effect automatically on day 60.

First offense suspension: 90 days if you took the breath test and failed. One year if you refused. Second offense: two years.
